Gentlemen,
FYI…. after talking to my attorney`s here on the ground in CR. I post on this subject. First I asked them earlier in the week to check on just how this CR law and the CD arrest could affect my hotel, employees and customers. They looked at my business model and operations here at SL. They looked at my hotel web page and the SL Hotel Face book page. They looked at CRT, my advertisements on the site, the forum, and how SL customers might be at risk.

Conclusions presented to me this afternoon… Their opinion is the SL Hotel & employees are not violating any laws nor are at risk for arrest of this law by using your hotel, bar or restaurant. Your SL customers are not at risk using their CRT discount cards at your hotel.
Your customers posting comments on the scene here in CR should be very prudent in their printed text on Trip Reports and Tica reports on CRT, what they post on Instagram, Face book and youtube until further notice or the Cuba Dave case is decided.
I am not going anywhere. I am really happy Football season is here.

The more I read, the angrier I get. B.S to to all who have taken the back seat and have hidden away. FREE Speech is what is at trial here. I am here to say that C.D. has been railroaded. Phuck you C.R. and those who are scared that you will spend a few months in San Sebastian. I fly back from my doctors appointments on the 22nd and if you want to arrest me at SJO, so be it. Shame on you guys who has profited from C.D.'s post in the past and now try to distance yourself from him.

As I understand it, this law was passed 2 years ago and until CD arrest nobody has known about it. Or if they did, nobody seems to have mentioned it or was concerned about it. So.....obvious next question...anybody know of other vague potentially hazardous laws in relation to this hobby that have been passed without much fanfare? I'm assuming the old saying "ignorance of the law is not a valid defense of breaking the law" applies in CR as well. Well, I'm here to get educated! Por Favor!!!

I understand your frustration but what could anyone here do? You or anybody else here getting thrown in San Sabastian certainly won't help CD. Seems like the only thing that might help is people pitching in to get him a good lawyer or maybe "grease the right palm" so to speak.

Personally, I would delete the above as it taunts the CR authorities and you may just get your wish, a run in with the CR authorities. You will not win. All that have posted make it quite clear that the laws of the United States do not apply and the CR authorities can basically do what they want. Why anyone, that has business and must be in Costa Rica would taunt and state the above is beyond my comprehension. I do understand frustration and self-righteousness but you are dealing with a country where one more foreigner in their jail would give them great satisfaction. Just does not make sense. If the post is deleted, I will then delete this response and the above quote. Why possibly make trouble for yourself and your customers as they will suffer if you are in jail?

As somebody who operates a business in CR, that may have been the dumbest thing he could ever do. He's asking to be CD's cell mate, one of 12 it seems. This is like what CD did (taunting the authorities) x 100.

Just googled San Sebastion prision and looking at the photos and how crowded it is, I just might contribute to his legal defense. It's terrible conditions especially for an american who is not used to that kind of life.

Totally agree with the above. Whether you agree or not, it's their country and I'm sure they're very proud of it. Putting a gringo in jail that insults their country wouldn't give them a second thought I'd imagine. There are plenty of messed up laws here in the states. One being the illegality of our hobby to begin with throughout the USA (well except in certain places in Nevada). I'd definitely delete it. Looks like the CD site has toned down it's message too which I think is smart. Nothing wrong with asking for financial help as long as you're not digging your own hole deeper. I'm hoping whoever is working on his behalf has contacted the US consulate. That would be priority number 1. Not sure how much they can do or are willing to help a man who's activities would be illegal in the states but they should definitely be involved. I have to wonder if prosecutors in CR are given much discretion? i.e. If he could strike a plea deal with a fine and be banned from country for pleading guilty and thus avoiding a trial and potential prison sentence. The way the law was worded doesn't seem like there is any leeway for prosecutors.

I have read every post on this site concerning cuba dave like most of you i have mixed emotions about CD but with that said!!!!!!!!!!!!!

Don't believe that he is in San Sebastián prison. Whoever posted those pictures got them off of Google. IMHO a sad attempt for people to feel sorry for him and send money for his defense. Truth is they do not put foreigners or Americans there, they wouldn't survive a week.

Costa Rica Preventive detention prison is in San Ramon and has much better facilities than San Sebastián.

Personally have no opinion on what happened but some of he articles are way off in reporting accuracy. He was arrested leaving the country, not arriving.

I will be curious to watch how this plays out.....
