In this case, I think - given the "smiley" - I think - think - he was kidding. :?

In any case it does not matter; I have a pretty thick skin and don't get offended very easily.

Why this issue bothers me is there seems to be zero accommodation on the part of those against smoking to accommodate those who do - I'll admit, ID I did not "study" the CR law and its nuances (however, voters in FL a few years ago voted in agreement with a simply worded amendment to the FL constitution prohibiting smoking in enclosed places - and there are many places - even some enclosed, like a bar who derives less than 10% of revenues from food - that allow smoking, all from a passed amendment that basically said ban it everywhere) - however.....in a resort atmosphere, it would not seem to be the end of the world to allow it outside, on a balcony - thats all.

Again, I understand both sides and think for those on the other side, will just have to agree to disagree.

I do stand up when I think I'm in the right, however - a couple of weeks ago, I'm in a park, in Broward County, with friends (Treetops, if you remember/know the place) - I finish my lunch and look forward to having a cigar - I pull one out - big, thick, black - beautiful, just begging to be lit and smoked.......<almost> better than food or sex

Anyway, this woman, about my age, who I knew slightly, said "You are not going to smoke that, are you?"

Resisting a number of snappy comebacks, I replied "Yes, I am - its not prohibited here, we are outside, and I'll hold it so the smoke does not come anywhere close to you"
"Now STFU and suck my C*ck" (Kidding - obviously about this sentence, but not the preceding one)

Its a knee jerk reaction many have to cigars - mine - and I truly wish they did not :( - cost $8 - $10 each - they are not Swisher Sweets, or Dutch Masters, or Phillies, which are mass produced and contain a lot of paper and other fillers vs only pure tobacco in the cigars I smoke - most think of these types of cigars - which cause a stench when lit and smoked vs a premium hand rolled (not my term; its how the industry refers to them) - I honestly think if more people gave cigars a chance, they might actually not find them offensive at all - OTOH, they might.

To paraphrase John Lennon, All I am saying, is give <premium> cigars a chance :)

Actually they are smart and you are the asshole for wanting to smoke in public. They are not only protecting their business but they are protecting the health of their guests, the majority being non-smokers.

Name calling huh, there should always be alternatives and private business's should always have the right to have a say.
We can both have places non smoking and smoking what would be wrong with that? Other than you seem to be one of many vocals who decide how we should live. Most all cigars smokers care about the people around them and would never invade your space if it bothered you. But we should also have been given a small section our money is green as well, none that outlaws it without finding a space will ever see my dough, Ecuador is better Phuck the social Nazis Yeah Nazis is a bit harsh I just couldn't think of a better word.

If you want to talk about Nazis, Ecuador is a good place to start being that it is run by a dictator. Good luck in your travels.

Dave, I agree with you and have always considered it a "restraint of trade issue" I believe that a business should be able to set their own rules (within reason, and never in a discriminatory way) and frankly, let the market decide - before all these smoking bans plenty of places prohibited smoking, and customers made the choice.

But you and I and other like minded folks are truly on the wrong side of history.

Yes, there should be a way - like allowing smoking on a balcony, for example - to accommodate both groups (because remember, many who don't smoke on a regular basis do so on vacation, wanting to kick back w/ a cigar <or even cigarette> while on vacation. But the anti smoking folks don't want any accommodation whatsoever - they want it prohibited everywhere - and that seems extreme to me - but again, we are on the wrong side of history :)

Hope you are well and your back is better :)

You can smoke in the outside patio at Key Largo.

Yes; you are correct; its a nice spot to do so, too :)

Now if the hotel I'm staying at in Jaco (the Cocal) had such an "enlightened policy" regarding OUTSIDE SMOKING ON A GUESTS BALCONY then all could be accomodated - kind of like at the Key Largo - sometimes the solutions are easy, if all sides are willing to "give/compromise" just a little

Think of it this way, if someone or even security themselves saw a person smoking on the balcony, can they tell you aren't going to walk into the room with it and then back out again, over and over again thinking that little walk, for just a moment, is harmless? They have to maintain a genuine smoke free room in order to tell next guest it is free of smoke.

I don't remember the hotel, but I assume the balcony is ordinary balcony outside each room, some adjoining.

I agree, some accommodation, but if it is difficult for them to know you aren't going inside the room with it, balcony might not be right accommodation.

I'm going to let your comments stand without comment except to say thanks very much for mentioning that there should be accomodations made :)

the hotel/ establishment either allows smoking or it doesn't. simple as that. there are far too many addled assholes who'll do just about anything to get their fix and assume the smoke would never waft from their balcony right through an adjacent rooms window - as though that shit stops cold and knows its boundary. the fuckers that really irk me are the ones that sit in a rooms chair holding their arm outA window. lovely.

Just like in everything their should be a place for us all. I would bet if it was up to the establishment there would be a compromise. What I see is non's or ex smokers drawing lines in concrete and could care less about any but themselves.

For those interested here is a website that you can search and book rooms that allow smoking I use it in the U.S. amazing how there are both smokers and non smokers in the same hotels.

yeah, they've actually made it ez & comfortable to have a smoke there. Chairs & tables & a party-tent type fabric covering of the area to keep the smokers dry from the raindrops!

I will assume the premise of your comments on smoking are based on health issues?

I have bad news for you. The air in the Gulch is much worse than terrible. The exhaust fumes from cars alone will make you sicker than any 2nd hand cigarette smoke. The toxic air in san jose is the one you should be concern with.

If you are as concerned as you seem to be, we will expect to see you wearing a mask during your next visit.

I have a question: is smoking also banned inside the hotel room @ the SL? and is this the new norm in all the hotels or do you know of a hotel that allows smoking in the room?
