Jamie McCourt is expected to ask a Los Angeles Superior Court judge to order the immediate sale of the Dodgers, two people familiar with the legal proceedings said Wednesday.

The request, if granted, could spare Commissioner Bud Selig from deciding whether to seize the club from owner Frank McCourt and risk a legal challenge to the powers of the commissioner's office.



Judge Scott Gordon on Thursday is expected to set a date to hear Jamie McCourt's request.

Jamie McCourt's position is that the actions of Frank McCourt — her ex-husband — have endangered the value of the Dodgers. She wants Gordon, the judge overseeing the couple's divorce, to order that the club be put up for sale so both parties could reap the maximum value for the primary asset of their marriage, according to the people familiar with the proceedings.

Matthew Hiltzik, spokesman for Jamie McCourt, and Steve Sugerman, spokesman for Frank McCourt, had no comment. Pat Courtney, a spokesman for Major League Baseball, said the league would not comment.

Jamie McCourt is expected to urge Gordon to act before Selig can seize the Dodgers so that the couple, not the league, would control the sale process.

In December, Gordon threw out a marital property agreement that would have granted Frank McCourt sole ownership of the Dodgers. At the time, Frank McCourt promised to use another legal avenue to establish the Dodgers as his separate property, but he has yet to file supporting documents in court.

In the meantime, presuming the team is considered community property under California law, Jamie McCourt has asserted her right to approve what Frank McCourt says is a $3-billion television contract between the Dodgers and Fox, a deal that he says would solve the club's financial troubles.

Fox does not plan to move forward with the deal unless Jamie McCourt approves it, for fear of her contesting the contract in court, according to two people briefed on the matter. Selig has said he would not consider the agreement until after his investigation into the Dodgers' finances is complete, and he has offered no assurances about when the probe would be complete.

Frank McCourt met with Selig last week and said he "emphasized the importance of timing" with regard to approval of the Fox deal, since McCourt is in danger of missing the Dodgers' May 31 payroll. If he cannot meet payroll, Selig could pay the salaries, seize the team and put it up for sale.

Frank McCourt has argued that Selig has essentially seized the team already. He decried the action as "un-American" and refused to rule out a legal challenge, saying only that he would "protect my rights."

In announcing the investigation last month, Selig also took over financial control of the Dodgers. He appointed former Texas Rangers president Tom Schieffer as a trustee and empowered him to authorize all transactions over $5,000.

In the process, Selig has assembled an executive team that could run the Dodgers' business operations through months of a sale process — or years of a court fight. Selig has made no appointments to the Dodgers' baseball operations staff.

In addition to Schieffer, the executives overseeing the Dodgers include John McHale Jr., the former president of the Detroit Tigers and the trustee who oversaw the Texas Rangers through their bankruptcy process last year, and John Allen, the former chief operating officer of the Cincinnati Reds.

The Dodgers have sold an average of 36,711 tickets through their first 23 home games this year, down 16% from the same number of home games last year. At that pace, the Dodgers would sell fewer than 3 million tickets in a full season for the first time since 1992.

The Dodgers are in third place in the National League West, in danger of posting consecutive losing seasons for the first time in 24 years.

Baseball Commissioner Allan H. (Bud) Selig issued the following statement today regarding the Los Angeles Dodgers' proposed media rights deal with FOX:

"Pursuant to my authority as Commissioner, I have informed Los Angeles Dodgers owner Frank McCourt today in a detailed letter that I cannot approve the club's proposed transaction with FOX. This decision was reached after a full and careful consideration of the terms of the proposed transaction and the club's current circumstances. It is my conclusion that this proposed transaction with FOX would not be in the best interests of the Los Angeles Dodgers franchise, the game of Baseball and the millions of loyal fans of this historic club.

"Mr. McCourt has been provided with an expansive analysis of my reasons for rejecting this proposed transaction. Critically, the transaction is structured to facilitate the further diversion of Dodgers assets for the personal needs of Mr. McCourt. Given the magnitude of the transaction, such a diversion of assets would have the effect of mortgaging the future of the franchise to the long-term detriment of the club and its fans.

"As I have said before, we owe it to the legion of loyal Dodger fans to ensure that this club is being operated properly now and will be guided appropriately in the future. This transaction would not accomplish these goals."

sure but its still $15 for parking and $12 for a beer. haven't spent a dime in DS for two years. now is the time for the total boycott so that pos has NO chance of making the june 30th payroll. he has an 8 million balloon payment to manny for all the money he deferred on that contract. if he was on the ground dying of thirst i'd put my foot on his throat.

The IRS been at all the court hearings taking notes on the testimony , that for some reason do not match the filed tax returns ( also part of the court record) So you may have to stand in line to get your turn :lol: :lol: :lol: :lol: :lol:

Here's the Dodgers' news release announcing that the team has filed for bankruptcy:

The Los Angeles Dodgers filed for protection under Chapter 11 of the U.S. Bankruptcy Code in order to protect the franchise financially and provide a path that will enable the Club to consummate a media transaction and capitalize the team. Dodger owner Frank McCourt cited Major League Baseball Commissioner Bud Selig’s refusal to approve the Fox transaction as the cause for the Chapter 11 filing.

I simply cannot allow the Commissioner to knowingly and intentionally be in a position to expose the Dodgers to financial risk any longer. It is my hope that the Chapter 11 process will create a fair and constructive environment to get done what we couldn’t achieve with the Commissioner directly.”

The Los Angeles Dodgers have tried for almost a year to have Commissioner Bud Selig approve a transaction, which would assure that the Los Angeles Dodgers would be one of the strongest capitalized franchises in Major League Baseball, both now and for years to come. Indeed, for months, the Dodgers have sought approval from the Commissioner of a multibillion dollar media rights transaction negotiated between the Dodgers and FOX, which would immediately infuse hundreds of millions of dollars of capital into the Los Angeles Dodgers. The Commissioner’s office last week rejected the deal, despite having been made aware by the Dodgers since the spring of 2010 of the franchises’ cash projections and in turn liquidity needs for 2011.

“The deal with Fox demonstrates that the Dodgers have enormous value which substantially exceeds the team's current and future liabilities,” said Bruce Bennett, bankruptcy counsel from Dewey & LeBoeuf. “The team is entering the bankruptcy case with enough committed financing to meet all of its short term expenses and to successful reorganize. The media rights will, one way or another, generate enough value to facilitate a reorganization."

Operating under Chapter 11, the Los Angeles Dodgers have received a commitment for $150 million in Debtor-in-Possession (DIP) financing. This financing will enable the Dodger organization to fully meet its obligations going forward. There will be no disruption to the Dodgers day-to-day business, the baseball team, or to the Dodger fans.

Under Chapter 11, the Dodgers will continue to operate in the ordinary course of business. Pursuant to that authority, and additional authority the Dodgers have sought in motions filed today with the bankruptcy court: All salaries of Dodger employees will be paid and all Dodger employee benefits will continue. The Dodgers will operate within their existing budget to sign and acquire amateur, international and professional players. Ticket prices will remain the same and purchased tickets will continue to be honored. All amenities at Dodger stadium will continue in place, and promotions will continue as usual. Dodger vendors and suppliers will be paid any post-petition amounts in the ordinary course, with the intention of paying any pre-petition amounts in full prior to or at the conclusion of the bankruptcy case.

McCourt concluded, “The Chapter 11 process provides the path on which to position the Los Angeles Dodgers for long-term success. The process will allow us to focus on maximizing value in a manner that is transparent and driven by the best interests of the Los Angeles Dodgers and our fans.”

Chapter 11 filings were also made for LA Real Estate LLC, an affiliated entity which owns Dodger Stadium, and three other related holding companies.
