Interesting article in today's Inside Costa Rica online newspaper -

22% Of Fathers In Paternity Test in Costa Rica Are Not The Biological Parent

Some 22% of fathers who undergo a paternity test are not the biological parent, according to the Laboratorio de Paternidad de la Caja Costarricense del Seguro Social (CCSS). Vivian Arce, director of the CCSS lab, says the test is 99% accurate and is based on an analysis of genetic material from the parent and Ch*ld. Arce explained that if the tests results are negative, the test is repeated to be 100% certain.

Every the CCSS processes 18 tests with results available in between two and three weeks. According to Luis Bolaños, head of the Inscripciones del Registro Civil (Civil Registry Entries), the Ley de Paternidad Responsable (Responsible Fatherhood Act) allows mothers to bring a paternity suit when the Ch*ld is born, which then falls on the shoulders of the Registro to notify the alleged father.

On notification, the alleged father can accept the Ch*ld and have his name added to the registry or request a DNA test. If the alleged father does not respond to the notification, his paternity is presumed. In 2010 the CCSS laboratory received 3.325 applications by the Registro, of which 31% could not be completed because the persons were not available for testing.

Actually this was thought by shrinks to be true. About 30%, Then some big lab paid Iceland to do DNA test on all citizens. When it was brought to the attention of the legislator that these results would show up. They kept the money and told the lab not to publish the results. Which did show that in about 30% of the cases the father on the birth cert. Was not the father by DNA. It is good old basic biology. Just another example of how equal we are.

Only One Third Of Single Mothers In Costa Rica struggle That Their Ch*ld Have A Father
Inside Costa Rica - Jan. 31, 2011

Only one in three single mothers in Costa Rica recurr to the Ley de Paternidad Responsable (Responsible Fatherhood Act) to ensure that their Ch*ld take the surname of the father, the other two thirds do not know of the law or do not want the father's name on the birth certificate. According to the Registro Civil (Civil Registry) of the 122.918 single mothers who gave birth, only 43.488 decided to fight for the recognition of paternity for their Ch*ld. The remaining chose to give the Ch*ld their names (in Costa Rica two last names are required for the registry - the father's is first, the mother's second ie Rodriguez Arias), either through ignorance of the paternity law or to avoid further contact with the father of the Ch*ld. Thus, a total of 79.430 Ch*ldren born in the last ten years do not have the father listed on the birth certificate.

The Responsible Fatherhood Act went into effect on April 27, 2001, which allows women to register the father's name on the birth record after giving birth. The process is completed by a DNA test if the father challenges the paternity. The testing is done, free of charge, by a the Laboratorio de Paternidad Responsable de la Caja Costarricense de Seguro Social (CCSS) if the father refuses to accept the responsibility. If the test results are positive, the Ch*ld will then bear the father's last name on the birth record and the father is responsible to contribute to the medical costs and Ch*ld care until the Ch*ld is 18 years of age or 25 if the Ch*ld is still in school. The law, however, does not obligate, nor punish a woman who refuses to identify the Ch*ld's father. The father, on the other hand can apply the law if he wants to exercise his paternal right and have the Ch*ld bear his last name. The law also allows that a Ch*ld, when he or she reaches the age of 15, can request a paternity test.

Interesting stat is how many can't be completed. Ticos are excellent at running and hiding from the police that look to serve the papers or enforce court orders.
Know from personal experience, many of these Ticas don't want the father on the birth certificate at birth (or aren't real sure who to name). This law allows them a second chance to name the father and it isn't final 'till the DNA comes back. But it allows them to begin getting Ch*ld support when they want too or need to to force the father to take some responsibility. That is, IF they can find the right guy. :shock:
Even more interesting is the enforcement. IF the police find the deadbeat, they serve papers. Then if he falls behind on the ordered payments, the police begin to look for them. IF they find them, then they have a chance to pay and if not, off to jail they go until someone comes up with the cash.
Have one Tico friend who does the 'hide-out' routine pretty often when he's falling short. Course with 5 K*ds and never married, he's in a tough boat but he climbed in there himself. Spent time in jail until mom just couldn't take it anymore...
