I know a lot of you guys have had a good experience at the Scotland Apartments. I have even recommended the place to several of you in the past. A lot of you guys are my personal friends.

Here is an on going story of what I am going through there.

I have audio and video that I will be adding. Going to see my attorney tomorrow. I am going to video tape that meeting and post it ..... so expect to see ongoing updates as this situation unfolds.

Watch the movie Pacific Hieghts. Maybe you can get some ideas on what can be done to a bad landlord? :shock:

I have stayed at this place and liked it... It is not for everybody !!!

To the poster.... did you sign that form when you took up residence?
They also have a policy about phone usage and if you go over 20 buck for curent

We have been positive about the Scotland in the past as well. We have had some minor problems, but the staff eventually got them worked out.

This is a situation where the owner has interjected himself into the situation and they are doing his dirty work for him. I feel sorry for Marlene. I think she is basically a nice lady, but the owner wants me out so he can get the higher rates that high season commands. Because it is dry season, the conditions are far better than they were.

I signed a lease. There has been NO mention of phone usage for 5 months. Now, all of a sudden, I have 5 months of phone due at rates that are about 10 times higher normal Costa Rica rates from the national communications company. Realistically, the bill should be about $40.

I have stayed at Scotland Apartments for a period of time. I have never had a problem and would recommend it to anyone as I have. Every person I have recommend it to, enjoyed there stayed and thanked me for the recommendation. The management always got things done in a timely manner when I had a problem. That basement apartment never goes for full price in high or low season. The cost for using the phone in the room is per minute and was spelled out for me. I always used my cell. There are always two sides to a story. I will continue to recommend Scotland to my friends. I totally enjoyed my stay there, and would still be there if I had not found a bigger place.

Before last Thursday I would have said the same thing. The on-property management is not the problem. The owner is driving this and he is typically not there. This really came out of nowhere for me. I am a pretty quiet guy, I bring coffee to the security guards, I pay my rent the first week of every month, just like I told them when I moved in there.

The only thing different with my situation is that I have a lease that is $200 a month under high season market value and rather than working something out that is fair and reasonable, he is using hardball tactics to throw me out.

Tomorrow I am going to post (on youtube) a conversation with the owner that I recorded. You will see that I came to them and tried to work something out in a reasonable manner.

How can a person live with such drama. I would move out tomorrow and find something even if I paid double. Life is to short to be bothered with such. How can you ever resolve this you could never feel comfortable again. End this and go where you can be happy.To take a private matter public is in most cases childish and self serving. In other words even with your rant you are in a no win situation. If money is that short maybe you should go back home. I feel like their is more to this than what you are telling. You seem like you could be a pain in the ass. No lawyer is going to take such a case so take the lawyer money and use it to move. Any time someone has threatened to get a lawyer involved I knock 75% off any claim they think they have.

Fair point Hernan .... that is what the Landlord is counting on.

here is the answer:

1) Cash flow is very tight right now and it is expensive to move. The philanthropic organization that I run is launching new programs right now, so we have more money going out than normal and new revenue streams have not yet kicked in. (I run an environmental org that is here working on Conservation and Reforestation projects on the Pacific coast)
2) This is the worst time look for an apartment, availability is limited and prices are at seasonal highs.
3) I am maxed out right now, both on time and money. This could not have hit me at a worst time. I have so much on my plate right now and I am doing it with limited resources.

Good News: As many of you know there is a Judge that hangs out at the SL. He and I are close friends. I am feeling a lot better after talking to him.

Seems that the landlord can go to jail for this and that there are serious penalties. I am meeting with a lawyer that my friend the Judge recommended today at 5 PM.

Bad News: It seems that the manager Marlyn, has either quit or was fired. I find this particularly appalling. The landlord marches out a 70 yr old woman to do his dirty work (Marlyn has been there 30 years), she is essentially forced to commit a crime to keep her job. When I questioned him about the situation, he totally bailed out on her and said he knew nothing about any of it. Then when it comes out that Management had had committed a crime by cutting off the power (not the power company as I initially thought) the woman looses her job. I feel really bad for Marlyn. She was just trying to keep her job and it is clear to me now that she was put under a lot of pressure to do this. I NEVER had a problem with her prior to this. At first it was hard to understand what was driving the 'over night" change in her behavior. Not it is all clear. The landlord was/is hiding behind the skirts of a 70 yr old woman.

Think you are all wrong a about Marlyn. She has been trying to retire for a couple of years now. She was just staying to train someone new and helping out. You are using her to enhance your case.

I am not working with complete information, so what you say may be entirely true.

I can say factually that the owner told me point blank that she is gone because of this. He may or may not have been telling the truth.
