Can any Brothers recommend (if there is such a thing) a good Immigration attorney that can help or prepare my Novia To Obtain tourist visa to come to the US on vacation. She has a good job with san jose company, Bank account and a daughter to come back to here. The first time she was turned down because I think she said to the Embassy that she would like to bring her daughter also. so they probably thought she was not returning I appreciate any help or advice anyone can give Tomrg |

If you think the only reason is the mention of the daughter, have you tried to do it again and have her mention her daughter staying in CR? |

There is absolutely NOTHING an attorney can do for her in case of a tourist visa. Don't waste your money. You can reapply in 6 months (I heard if you go back in less than 6 months, they will automatically decline you, according the Immigration Secretary for my congressman). Law 214b states that the burden of proof is on the applicant to show sufficient ties to their home country when applying for a tourist visa. And the whole process is totally subjective, whether or not you are granted a visa depends completely on the IO that interviews you and is not appealable. http://travel.state.gov/visa/frvi/denia ... _1361.html "Every alien shall be presumed to be an immigrant until he establishes to the satisfaction of the consular officer, at the time of application for admission, that he is entitled to a nonimmigrant status..." |

If your computer savy you can do it yourself. Go to the immigration website and download the correct forms. The forms come with instructions. |
