We've been profiling since before 9/11 (legal or not). Since when have wwe been concerned about legalities. Was recording every telephone call made to and from the US legal ? Sure as hell not until El Pres made it legal.

We listen to what the Mossad in Isreal has been telling us for years. We don't even inspect the 20% of stuff that is on every plane as "cargo." We don't have a clue as to what is in the hold of a passenger plane. Fake manifests, etc...phony shippers and receivers. You could literally ship to the US 100 shoulder held rocket launchers. Home Security did precisely that in April and they passed though with no problems. Add to the fact that only 6% of the cargo arriving by ships will ever be examined.
A recent interview with the head of security for El Al described in pretty substanial detail how they do it. A highly trained psychologist in interrogation chats with 1-2 minutes with every passenger boarding an El Al plane from anywhere in Europe. He asks when were you last in Pakistan ? Even if the passenger responds he's never been in Pakistan and his documents don't show any such flight. The terrorist who is already nervous as hell now thinks that security may be on to him. His reaction is noted and he is then directed to further interrogation with another agent. If he still appears suspicious the guy is taken to a special interrogation room where two guys have a go at him. According to El Al they've never failed to ID the guy. If he is legit, no problem, a simple apology and he goes on his way.
Here we hire a contractor who has the low bid and he brings in wand wavers with little training and that was the extent of security prior to 9/11
As for profiling...why the hell not. If you look Muslim,act Muslim,you are suspect. Who gives a damn if they are offended. If you are Hispanic, coming out of Colombia, you are a potential drug smuggler and submitted to some of the most degrading searches possible. We've been doing that for more than 20 years.
The American public has voiced displeasure over carrying a national ID card. If you've got nothing to hide then that is a minor inconvenience and we didn't hear a big protest when we learned our govt was secretly monitoring every international financial transaction and phone call. This is a WAR and in war you take drastic measures. Do we hear any of our brave soldiers complaining they don't like to be in all that sand ??
Invasion of our civil rights and privacy...Get used to it. It won't end in our lifetimes.
