I've been reading a lot of threads lately, with people worried about how they may get stuck with paying Ch*ld support or a chica slapping an "impedimento de salida". You don't have much to worry about...unless you're married to her. If you have a women tell you that she's pregnant and it's yours, unless she has been living with you for an extended duration and all of her family can prove it, her word doesn't hold weight. I have multiple friends going through this exact same thing. There is still a burden of proof on the women to provide, otherwise women would just walk up to any gringo on the street and say they are the father! As far as the story about some women putting another man's last name on the birth certificate ? bullshit ! It took me 3 court appearances to even get my name on my daughter's birth certificate. My daughter is now more than 1 year old, and it's taken most of her time in life with me to get the paperwork done. The Costa Rica government is extremely reluctant to do this, and I had to appear for all court dates with multiple forms of ID, signed documents, and HER family members confirming our relationship, to get it pushed through. End result was that even after the 1st couple visits with the judicials, they still wanted that last appearance before final signatures, and my confirmation that I truly wished to do this. Last point...you marry a woman in CR...you can't get a divorce for 3 years. That's the minimum wait time for divorce applications, they won't even let you file until then. During that time, if she gets pregnant...it's yours for life. Marriage is the 100% guaranteed way that you are the father...period. Doesn't matter if it's not your DNA...it's yours anyway, plain and simple. For the guy who married Sophia, good luck. For anyone else thinking of doing the deed legally and binding, think twice. |

Not to hijack the thread, but I have a related question that I don't see has been discussed here before. What if a guy goes to the DR or a message parlor and for whatever reason (i.e. condom breaking) a working girl ends up getting pregnant? Is the guy legally responsible for the Ch*ld or is this considered to be an occupational hazard on the girl's part? Not that I would ever blow off the responsibility if it were to happen to me, but I'm just curious what the law states for a girl who gets pregnant while working as a prostitute. |

I know of a few cases through my attorney, that burden of proof is a little gray.Judges rule diff. in some cases they have room to move either way. Nothing down here is in stone. kinda like comon law |

For the most part this is true. But, if you should marry a working girl and she continues to work post nuptual, you can file on the grounds of infidelity at any time. You just have to prove that she is still offering services. Which, in most cases, would be a slam dunk. Although it DOES take proof, not just hearsay. Just because she is "in the HDR, dressed like a ho," is not sufficient proof. dapanz1 |

Just for the sake of arguement, assume that in my example that the condom breaks and she knows about it, and it is the only time something like that happens to her in a two or three month stretch, and the guy either lives down there or is a frequent visitor who she can easily recognize and identify. Does the fact that she works in prostitution and assumes the risks of her profession preclude the gringo from having any type of responsibility for the Ch*ld? |

Maybe it's just that the people I know are a little smarter, or have better lawyers, or have better luck because they live in Costa Rica. I have 3 friends that live here, gringos, that have had numerous women attempt to corner them in this type of thing. It never works. All 3 of them at one time or another have had steady association with women from the DR, and these women have tried various ways to trap them into thinking they are the father or making them pay support. Many will go so far as to "claim" they are pregnant, when they really aren't, or even know they were pregnant before, and try to pass the blame on to the gringos. As Dougpi stated, there are "gray" areas. I can think of perfect examples, like letting them live in your place for 9 months or more and they get knocked up during that time. That puts the guy in an extremely bad light, especially if she gets all her friends and family to back her up. One of the best ways to counter this type of tactic is make 100% sure that all receipts and travel information is kept readily available, so burden of proof is back on her to provide additional information on parentage. If it does end up going to court, a true DNA test will need to determine the outcome. This is of course assuming that the person is an expat, and leaves the country at normal intervals of 90 days or less. Modern medicine has been able to determine the time of conception close enough that you can drag her ass down to CIMA and get tested to find out approximately when it occured. If it happened to coincide with some romantic getaway week in Jaco...good luck ! |

As far as prostitution is concerned...it's legal, legitimate, and has the same risks as a freebie. Review the info above....if you aren't married to her, it's almost impossible for her to pin anything on you. Burden of proof would be so far out of scope on a one time thing, that it's unheard of. What's she going to do...take all of her customers from a week's worth or working into the courts to force them to get DNA tests ? funny. This is a typical Jerry Springer or Maury episode. Imagine a women requesting to the judge a court order to have 60+ guys DNA tested, half of them gringos. YA, that would go over well. |

Every Gringo I know well that has lived in CR for several years has had a problem with some Tica claiming a problem with them whether it be a hooker, maid or girlfriend. Once things are not going well & their little Tica powered minds spool up some little scam they have little to lose but to try this. They know it will be a pain in your a$$ no mater what & is their way to get even for being mad. I know guys want so called normal girlfriends instead of P4P gals but the cost can be so high. The more women in general know about you the more they turn that against you (the nature of the beast)! It is different when you live in CR verses cuming & going since they know where to find you as a fixed target. I just think it is VERY foolish to let them have any real information about you. Rent them by the hour whispering sweet NOTHINGS in their ear as there is always a replacement near by. |
