Gay Adoption Out, Legislative Commission Decides

The homosexual community in Costa Rica is being left without the possibility of adoption following changes by a legislative committee to the Código de Familia (Family Code). The decision was made public Wednesday by Mario Núñez, chairman of the Comisión de Juventud, Niñez y Adolescencia.
"The state must assure that minors up for adoption are handed over to heterosexual couples as it is established in out Constitution, Christian principles and our idiosincracy", said Núñez. The changes to article 107 of the Código de Familia must now be approved by the legislative assembly.
The text of the changes are clear prohibiting adoption by an individual or couple whose sexual orientation is of the a person of the same sex.
Núñez said that though adults have the right to maintain a gay relationship, the same right does not extend to burden a minor with the responsibility of having to understand that "his or her" family is an exception to the rule.
Núñez added that many Ch*ldren may be disadvantaged if they were to be adopted by a gay parent, possibly living a situation of ridicule and censure.
The only such of gay adoption in Costa Rica occurred in 2004 when a judge allowed transvestite Luis Mairena to be the legal guardian of a Ch*ld he had care for from infancy.
