In my opinion, the thorough thrashing the Constitution took under GW will have the longest negative effect. They got away with ignoring the Constitution (when they didn't shred it completely). That set a precedence that cannot be set back.
Please provide specific examples. The Constitution is meant to protect THE PEOPLE from government, and that includes larceny and theft, which is what we are seeing.
I'm working from memory but I'll give it a go: After the terrorist attacks of September 11, 2001, Bush authorized the NSA to monitor, without warrants, phone calls, e-mails, Internet activity, and text messaging, and other communication involving any party believed by the NSA to be outside the U.S., even if the other end of the communication lies within the U.S. It went further, even to monitoring communications from American servicemen in the war zone to their families back in the US.
Why is this important to us? Because the right to privacy is a basic right and one of the cornerstones of our democracy: freedom from the prying eyes of the Government unless their is probable cause for the action.
In an attempt to protect our basic rights while protecting the citizenry from terrorist activities, it was established by law that the administration could monitor suspected terrorist activities as long as they procured a warrant from a special secret court, before or after the event. Bush ignored this law, a violation of his oath of office.
Why did the administration feel the need to circumvent the law and the court? Because they never intended to limit the invasion of privacy. Instead, they set super-computers loose on all communications searching for key words (which were left to the discretion of the secret operators who did things like entering intimate language so they could get a kick out of listening to intimate conversations between the servicemen overseas and their wives and lovers. Quaint.)
This wide scale violation of the rights of US citizens is rife with opportunities for abuse. Imagine what an advantage it would be politically or in business to know what your competitor is thinking or planning. Whoever is running the listening program has carte blanche to pursue any information they would like without oversight, without any accounting and without the benefit of law.
You may argue that the ends justified the means in this instance. Even if I agreed with that (I don't), as I said, the precedence that this sets opens a Pandora's Box that cannot be undone. Now, the President can do whatever he wants, in secret, without oversight, in direct opposition to existing laws and the Constitution at will. For some of the Obama haters, this should curl the toes!
By the way, this surveillance is ongoing.
