Technically he is within his right to smoke and still compete. He is allowed to use marijuana (specifically mentioned in the bylaws, as well as some other drugs) as long as he is not competing (or in a current competitive season). The season does not start for another month or two.

He took the short course season off for a break. Long course starts at the end of March...

SC - compete in yards
LC - compete in meters

Having said all that, it's the sponsors and the image that he has to worry about, not whether or not he will be allowed to compete.

Personally, I think he should say: "Phuck you, how many gold medals have you won?" and smoke another bong...

Of course, this could open up a whole new spectrum of advertising for him...

Bong manufacturers? Cannabis dealers?

Lots of money to be made in the drug biz... why shouldn't he get a part?

Putting the whole pot debate aside......

The guy is a freakin idiot. He has $100MM in endorsements b/c of his Olympic accomplishments coupled with his good looks and "role" model choir boy image. The fact the he would put himself in that position is stupid. He knows whats on the line. If he like doing that, fine, do it alone or with 1 person he really trusts with no phone cameras, etc. around.

Phelps Congratulates Cardinals on Super Bowl Win
Olympic Champ Praises Doritos Ad

Olympic champion Michael Phelps weighed in today on last night's Super Bowl, congratulating the Arizona Cardinals on their "awesome victory."

"The Cardinals really tore it up last night," said Mr. Phelps, who said he saw almost the entire game until he got "a wicked attack of the munchies" late in the fourth quarter.

"Maybe it was the Doritos commercial, I don't know, but suddenly I got unbelievably hungry," said Mr. Phelps, giggling uncontrollably. "I was like, man, I have got to get me some Doritos, stat!"

Mr. Phelps said that once he got to his kitchen, he became distracted when he noticed that his hand appeared to be growing.

"I must have been staring at my hand for an hour," he said. "It was kind of fascinating."

The Olympian said that by the time he returned from the kitchen, the game was already over, "so I didn't get to see the awesome moment when the Cardinals actually won, but I'm sure that was bodacious."

Mr. Phelps said he celebrated the Cardinals' victory by eating four bags of Doritos and swimming a victory lap on his living room rug.

The way I see it, Phelps is among the many athletes (Plaxico, Vick etc) who have everything going for them but manage to self destruct. Granted he has not blown up like the above mentioned dummies, but he has come close. He should have chosen a better venue, maybe alone to toke up.

While his current sponsors might not have dumped him (yet?), he has lost many millions in future sponsors (goggles, ear&nose plugs to name a few). While most Americans will shrug it off, many parents will have an issue with this.

My dos colones.

Phelps' problem was that he forgot that just about everyone has camera phones these days and if you're going to do a bong at a party then someone will take a photo of it. Then it's Reefer Madness yet again.

I think its unfair to expect athletes to be moral role models. That is thrust on them by the media and fans who deify them. He should tell people to phuck off and then smoke another bowl and then get 12 more medals in 2012.

You're absolutely right it was careless and though he's young most people would probably take those simple precautions. But I just can't get around how distorted reality is when it comes to issues like this. If he were drinking a double scotch and water nobody would care, or would they?

No offense Haywood....but is the sky blue in your world?

I would tend to agree a little with you if all these endorsements were not in play. BUT.....

This isn't Phelps' first rodeo...the guy almost broke Spitz's records in Sydney. He absolutely should know better AND IS a moral role model. Why the hell else would he be getting all that endorsement money.

Sorry...but when you become the "face" of a product/ company, you do take on a greater responsibility.

Like Brother Tstef527 said--No matter the merits of the case, fame was not thrust upon Mr. Phelps; he sought it out. If he's not ready to bear the burden, well, there's always croquet. I still think the whole matter is a tempest in a teacup and to compare him to Plaxico Burress and Michael Vick is a bit overmuch. Their crimes will be remembered in a year, Mr Phelps maybe not. He nevertheless has been seized upon as a good example of a bad example.

One other thing--He was stupid to use a bong; a vaporizer would have been a better choice. He needs to be concerned about cutting his lung-power.

I love how hardly anyone jumped on Phelps when he was caught for his DUI a few years ago....but now that he's been photographed taking one bong hit they've released the hounds on him.

Granted I think the guy's kind of a moron anyways, but a DUI is definitely worse than smoking a little reefer

Also that sheriff in South Carolina who's gonna bring this case in for investigation....good use of the taxpayer's money, don't you realize we're in a recession dummy?!?!?!?!

Very good points!
There is larger picture here which is the insanity of binge drinking being pretty socially acceptable but if someone smokes a little grass people freak out.
Yes I know grass is illegal but its an incredibly immoral situaton to put people in jail for having a PLANT.
Many athletes use weed to relax as do many lawyers, doctors, teachers and countless others.
It is our birthright to use plants for healing and pleasure.
