I know this isn't the right forum for this topic, but somehow it didn't seem appropriate to post this in "Smack Talk and Fun Stuff". You may be familiar with the story of Jon Hammar, the ex-Marine from Miami who has been imprisoned in a Mexican jail for the last 3 months on a charge of smuggling guns into Mexico. Jon is currently chained to a cot in his jail cell, and his family gets RFMs - yes, request for money via WU -- from other prisoners threatening to harm Jon unless they receive protection money. Read it this am.It does belong here--this Marine was headed to CR for surfing. I followed thru with your advice. He declared the gun, a family heirloom, when leaving our boarder and going into Mexico. Shotgun was an inch too short per Mexico law as per the MSNBC story. Probably more to the story (not meaning to infer neg inferences about him) behind the scenes as this non-violent criminal act would seemingly avail itself to a 1,2,3 diplomatic resolution between boarder countries that have repeatedly vowed cooperation with each other, or have been to a hearing in Mexico's court system by now.There's a fly in the ointment. |

if you reside in a foreign country you learn very quickly that you can expect little or no help from the U.S. Consulate if you are arrested. This is the State Departments official stance on the subject: Quote: Arrest or Detention of an American Citizen Abroad One of the most important tasks of the Department of State and U.S. embassies and consulates abroad is to provide assistance to U.S. citizens incarcerated abroad. The State Department is committed to ensuring fair and humane treatment for American citizens imprisoned overseas. We stand ready to assist incarcerated citizens and their families within the limits of our authority in accordance with international law. We can and do monitor conditions in foreign prisons and can protest allegations of abuse against U.S. citizen prisoners when requested to do so. We work with prison officials to ensure treatment consistent with internationally recognized standards of human rights and to ensure that Americans are afforded due process under local laws. While in a foreign country, a U.S. citizen is subject to that country's laws and regulations which sometimes differ significantly from those in the United States and may not afford the protections available to the individual under U.S. law. Persons violating the law, even unknowingly, may be expelled, fined, arrested, or imprisoned. Privacy Act - The provisions of the Privacy Act are designed to protect the privacy and rights of Americans, but occasionally they complicate our efforts to assist citizens abroad. As a rule, consular officers may not reveal information regarding an individual American’s location, welfare, intentions, or problems to anyone, including family members and Congressional representatives, without the expressed consent of that individual. Although sympathetic to the distress this can cause concerned families, consular officers must comply with the provisions of the Privacy Act. Worldwide Caution That does not mean that there are not backdoor negotiations going on between the U.S. and Mexican governments but do not expect to see anything official announced. Hopefully negotiations are underway and the issue will be resolved quickly and result in Mr. Hammars release |

He should have left his gun at home! It seems he did fill out all the paperwork and still got arrested even before crossing the border?! Quote: They said, 'Technically you can (bring it across) but you'll need to register it,' and had (Johnny) fill out paperwork to present to Mexican officials. Quote: Hammar had hoped to hunt small birds with it while living in Costa Rica, Olivia said. That would have been illegal anyway!I hope he will get out soon! |

He must of found something probably on the web that stated he could legally carry it to CR but my God he still would have had to try and cross thru Guatemala and Nicaraga with any kind of weapon even antique. WTF?? He received some very bad advice somewhere compared to the real deal. Anyway although he was chained to his bed for awhile it was in a safe area out of general population so need to give Matamoros/Tamp. officals credit at least for a safe area for him until freed by their bureacracy (remember they are at internal civil war so lots of stuff goin on). And sounds like tonight per Sen. Nelson it looks very good for him getting out thanks God. |
