I know of two buddies with good businesses that got married and then divorced from Ticas. Both of them had all their assets in SA shelled corporations, and the ticas got NOTHING. One even owns a 3 mini million dollar hotel. Now the Ticas were not former hookers and they did not have K*ds. One signed a prenup and the other did not, but the key is all their assets were in SA anonymous corporations.
Further I know of a Tico who has significant wealth who pays 40 dollars per month to his ex live in for 15 years and two K*ds . Know why? because he is over 55 and the government will not put a large pension on him because the protect citizens over 55 (funny how most the lawmakers are probably over 50 coincidence?), probably does not apply to americans. Further they cant prove how much he makes because he has his own business and all his assets are in a SA as well. He got everything taken from him by his first/former wife so now he went over board with this senario being a devout weasel since the costa rican law burned him so hard before.
What he did is not ethical or acceptaple, The point is the laws are so favored towards the Chicas that the Ticos and lawyered up expats go overboard the other way making sure that they shelter all assets, and try to give nothing when in reality they should be supporting their K*ds.
Now looking at this 2-3 year live in law, its looks as if you dont have a prenup and no corporation you are screwed, better of to marry her with a prenup after a year and a half(english and spanish). But the Tico mantra would say you deserve it because you could have protected yourself before someone stole HALF. Lawyer up fast if you have a live in GF for over a year, 500 bucks could save you half of your assets.
The Ch*ld support depends on how much your taxes say you make per year, and how fat your bank account is, and what her needs are all these things are considered, they do a full on "investigation" thats the word my attorney used.... of your assets and earning ability including an anal probe, just like a lawyer would do in the US. If you talk to most chicas they think that they can get 500 bucks per month per Ch*ld, this is their word on the street knowledge of what they think they deserve, if you are a poor gringo with no job or assets you probably pay as little as a 100 month, and they will jail you if you dont come up with it ... the reality is somewhere between 200-400 a month, heck thats the average monthly salary, but if you make alot of money and havent protected yourself and its obvious through your taxes you make 20 Grand a month you could easily end up paying her well over a grand a month. But if your wealth is in an Business SA or US LLC they cant touch that because corporate law shields it from thieving gringas/ticas so the crazy ones cant destroy business and ergo jobs by going nuts on a /business to get half and in the process blindly destroy the business thats... why the law protects you the business owner, because so many business use to get put out of business,with jobs being lost companies Bankrupted all because angry ex wives.
In CR you need to be legally prepared and protected and then you will have the negotiating advantage when things go bad with your Tica. Do find a lawyer and consult if you have any worry whatsoever about your girlfriend, and DO NOT rely on a bulletin board for legal advice when its your assets/future at stake just pay a lawer for a few hours so you are armed with knowledge. You should give her something and be ethical but Half is not really fair if you worked 30 years to earn it and she steals half in 2 years.
Paco if you do have a K*D accidently that you dont didnt intend to.... you probably should nip it in the bud and offer her 200-400 a month without a fight and offer to be involved in the childs life. Because if she gets mad and you havent protected your self it could get a lot uglier than 200-300/month
